Can You Appoint a Substitute Attorney in a Hong Kong Enduring Power of Attorney (EPA)? Why is the High Court Refusing to Register "Second" EPAs in Advance?
Hong Kong's Enduring Powers of Attorney Ordinance (Cap. 501) provides no mechanism to appoint a substitute attorney on a single form. The old workaround — a second EPA taking effect upon revocation of the first — is no longer accepted for advance registration by the High Court Registry. If the donor has lost mental capacity and the first attorney dies, would assets risk falling into a "power vacuum" with no one authorised to act?
